Carmax hides the truth about car's accident history.

Hi guys,
I'm very upset at carmax, I bought a hummer 3 from them 2 years ago, and yesterday I found out that the car had been involved in an accident back in 2007. That was with the first owner. I was trying to get a new car from my local vw dealership and they ran a carfax report.
What is the law in CA when selling a car? are not you supposed to inform the new owner about the car's history?
I'm thinking about going to carmax today and sell them back their "pos" car.
What do you guys think I should do?
Thanks

Did they tell you that the vehicle was never involved in an accident ? Or did they just failed to mention it at the time of purchase ?

unless you asked for a carfax report when you bought it....its not the dealershisp responsibility to tell you if it was ever wrecked of anything like that.
I hate carmax with a passion though. they are a huge ripoff. dont pay you near what other dealerships would give you on trade and do not allow any haggling on their prices.

They failed to informed me about the car's history, I trusted the company but I should have asked for a carfax report.

Sorry to hear that man but as R1nStang said they aren't obligated to say anything about their cars nor is any other deal for that matter.

not everything from the car's history will appear on the carfax report, carfax reports what they know...they cant report what they dont know

sadly...its not their responsibility to inform you about anything except for a salvage title...but i bought they would have bought it to begin with if it had one of those.

its on you
you should have had an independant inspection done prior to purchase

that 50, 100 or whatever it cost you would've made things much easier

i never understand when people buy a car worth more than a few grand without having it inspected.

OP the responsibility to verify the vehicle's history, condition and value is solely on what you are willing to pay. If you don't ask, they don't need to disclose. It's called due diligence. Live and learn from it. Had a friend in college who tried to sell his honda accord. Found out it was salvaged and bascially 2 honda accords welded together at the b pillar.

Carfax is worthless anyways because people don't report anything anymore. People should learn things to look for when looking at a car. Best investment you can make is car knowledge

Yep. They sold you the car you wanted. Buyer beware. Lemmings getting what lemmings deserve.

I do ask for a carfax report but i also i inspect the car down to underneath.

Making sure headlights and seams line up. Overspray. And that sort can clue you in to history of the car.

So you had no issues for 2 years but now you want to sell it and you think they owe you something because you didn't check the history? What damage does carfax say it had...you sure the new dealer isn't just trying to screw you over deducting for stuff that doesn't matter. MANY cars get repairs for many different reasons

That sucks I think your sol. Caution is defiantly needed when buying used. My friend bought a car from Carmax a few years ago and a couple moths after purchase he found a small leak under the transition. They refused to fix it without a huge fight because they claimed it wasn't a leak that it was only seeping. After seeing my friend go through that ordeal I wont buy a used car without them picking it up on the lift for me.

I always thought those H3s were a wreck when they rolled off the assembly line.

Just because a car has been in a fender bender and needed a new bumper cover doesn't make it a shit car

Also, always spend the 100 bucks or so and take it to an independent "lemon buster" shop or something similar. Its amazing what they will find on a car when they are trained to look for it.

im pretty sure that whenever you get maintenance done on your care since for instance the dealer uses the vin number, all repairs/work done on the car is recorded and sent carfax.

even your jeffy lube people use your vin# to keep track of your car... and i wouldnt doubt it that they also report to carfax. there's a reason everything is driven thru your vehicle Vin# and it isnt to just identify YOU as the owner!!!

but to the OP, you shouldve checked it, i mean; it is posted on most of thier car listings. it suckes that you purchased a car that had been on a wreck bu you wouldnt be the 1st person to buy such car and unless the car underpoerformes due to the accident then there's nothing to complain about.
