Another South FL Stolen Bike
Well it took those bastards 8 months, but they managed to steal my bike last night. Not only am I crushed that my bike is gone, but that was my only transportation. I live in a condo building with gated valet underground parking. There is also a "security" guard no more that 100' away from the only entrance/exit to the garage. conveniently the valet left the gate open all night. If anyone sees a 02 silver r1 with a 2# nitros bottle right below the passengers seat, let me know. $1500 if someone can help me find this thing. No questions asked. I am just going to murder the person who did this

Did you have insurance on it? Does not make any sense the valet left the gate open. Check into your legal rights with the complex. The valet may have been a part of the theft.

Check with a lawyer, but your valet service is probably going to be legally liable.

I would bet money the valet was in on it. I feel bad for you guys that dont have garages to lock you baby in when its not being used.
hope it all works out for you, sw florida aint great for bike theft, but south east florida is the worst

No I didn't have full coverage on the bike, so i am just S.O.L. I think it was an inside job too, and I am looking into the legally aspect of it. I called about 30 lawyers today and really found nothing out. I am going to try again tomorrow. Of corse there are big signs out that say "management is not responsible for anything lost or stolen" The valet company and the Security company are all hired by my condo so I don't think they would be considered management.

alot people seem to get their bikes stolen on the forum, i leave 98 r1 and my 07 harley parked in front of the house, dont even bother locking the steering and theyve never been stolen. and im not even in a nice nighborhood

Call an attorney and ask them what the law is concerning voluntary bailment where you live. Voluntary bailment is where you leave your possessions with say, a service, such as a valet or a auto repair facility, and they voluntarily take possession of it. When they do that they assume certain responsibilities and liabilities. In your case, I believe they voluntarily assumed possession of your bike, as a service, for a fee, and now they are liable for certain things. It doesn't matter what the hell anybody's sign says.

Sorry bro, I feel your pain. I had mine stolen about a month ago. I had back up transportation though. I hope you can get some legal help on this one. When I was a kid my mom had her car stolen out of valet parking at Circus Circus in Reno. The hotel paid for it, so I hope you get the same treatment since they did not use their security measures they had in place. Could maybe follow the assclown security guard and see if your bike is in the area. Just don't do anything stupid if it is, call the police.

Check on that i bet they do. And i hope they guy who left the gate open is in it helping so you can sue the company

Ouch that sucks man. The feeling is horrible. My bike was almost stolen too, but luckily they didn't take it. Hope you get her back.

i am not a lawyer, but i get the feeling that all these valet and/or parking places do not offer compensation for stolen items.
I had my car broken into several years ago and they showed me the contract.
Yeap, it was in there: not legally reliable....

The condo parking space is probably just a license arrangement. No contract bailment here, but maybe a negligence theory for leaving the gate open. It's probably worth going to talk to a local attorney about it if he doesn't have insurance and doesn't care what the condo/complex management or owners think of him.

Well I found a lawyer that will help me out. He thinks there is a pretty good chance both the valet and the security should be liable and they both were negligent. He is going to send out a few letters and see where that gets us. I will keep every informed. As far as those not liable signs you see everywhere. Bullshit. They are there to hopefully trick you into thinking they are not responsible for anything that happens. They hold no legal value. I think there is a lot of blame put on others, and a lot of bullshit lawsuits, but I really think someone was blatantly negligent and should be held responsible.
