Wrecked 2012 R1

Yesterday I was at my dealership waiting for the completion of my new Ohlins suspension installation to be finalized. The last thing that needed to be done was a verification ride by the tech to make sure everything was running and working properly. As the tech drove off I waited in the parking lot so I could hear my exhaust as he drove back from the quick ride. Five minutes past and he didn't return. I went back into the shop and waited a little longer before I was approached by the manager saying my R1 had been wrecked. ? A lady had pulled out of her driveway as the tech riding my motorcycle came down the road eventually slamming on the brakes and smashing into her front end. I was told he walked away from the wreck but was also transported to the hospital to get checked out. My main concern was that the rider was safe but now its setting in that I don't have me bike and more to it that its wrecked. Most likely totaled since the estimate by the shop was around $22k. I'm waiting on an inspector from the ladies insurance company to take a look at it now which probably won't be until Monday. My question is what do I do in the meantime? I'm really anxious and want to get back to riding before it gets too cold outside. How do I handle this situation where someone else was riding my motorcycle who got into an accident that wasn't their fault. What steps do i need to take and what routes do i pursue?

I would expect the shop to be covering this. the incident occurred while the bike was in the possession of them/one of their employees. They should have insurance to cover these types of situations.

Id like to think the shop will reimburse you ASAP, ad chase up reparation from the at fault party, that would be the ideal scenario.

Id approach the shop and discuss this with them, but remember to remain calm and open minded. they may offer you a decent loaner bike to use until it all gets sorted out. A messy situation, but provided everyone remains calm and reasonable, I cant see why it couldnt all work out well for everyone.

As far as I know the shop isn't covering anything. I will have to get more information though on Monday. They told me that the lady took full responsibility so I don't know if its a battle between the lady's insurance and the shop. Or the lady's insurance and me. I mean its a one way battle but hopefully you get the idea.

The problem here is the dealership is trying to keep themselves out of it by hoping the lady's insurance company handles it, yet they seem to be keeping you out of the loop from bargaining with the lady's insurance company. You do NOT want the dealership negotiating for you. IMO, your claim is with the dealership's insurance company, and their claim is with the lady. If it happens to work out that the dealership still works this claim, you need to make sure you get every last penny that her insurance company pays them; don't let the dealership get a $12,000 check, then turn around and tell you the bike value was $9,000 and that's all you're getting. You need to talk to your insurance company and quit talking to everybody else; they will tell you exactly who is responsible for what.

You have a brand new bike with just over 1k miles and a boatload of mods.

The dealer was in possession of your bike, the dealer totaled your bike, now the dealer has to take full responsibility.

This is between you & the dealer. Did you file a police report? An accident/loss of that magnitude is required by DMV to be reported.

You're not the one who drove into the lady, so you do not need to talk much with her. Again, this is between you, your insurance co. and the dealer.


Case closed.

So far the shop has been nothing but cooperative with me. I guess you get treated how you treat others and throughout my business days with the shop I have been taken care with high respect. I just got off of the phone with my insurance company and they are sending the adjuster out today hopefully but its looking more like first thing tomorrow. My insurance representative got me in contact with the rep for the lady that was at fault and I had a pleasant conversation with her. She stated that since the other party is taking full liability then it didnt have to involve the dealerships insurance. The only time it could possibly get the dealerships insurance involved is if the other party's insurance plan couldn't cover the damages toy motorcycle. It appears that through the headaches and stress that everything will be taken care of by the end of the week. I have been authorized to purchase a new motorcycle also so I'm going with the 2013 R1 metallic grey since in my opinion it looks more badass compared to the other color choices. Once I have my new motorcycle I can then wait for the money to order all of my aftermarket parts. Should be by the end of the week. They include a full Akropovic Evo II titanium exhaust, Ohlins front and rear suspension, CRG shift levers, Scott's steering damper, K & N air filter, PCV, Graves smog block off plates, rear sequential tail light, AdaptivTech radar and laser detector and laser jammer, LSL frame sliders, and stomp grip tank pads. I will also buy back my salvaged motorcycle at the price they give me. Hopefully around $4000.

Thank you. I'll take a look at it. Anyway a slight update... The insurance adjuster came and looked at the bike today. I talked with him a couple of different times and he kept mentioning that my policy only covers a certain amount for aftermarket products. I questioned him as to why he was looking at my policy in regards to this because I am not at fault. The other party's policy should be the main focus. But as I keep thinking about some of the comments the adjusted was making, I came to the assumption that the insurance company isn't going to battle it out with itself since me and the other party are covered by the same insurance company. It feels as if the adjuster wants to estimate in honor of me (which they should since I'm not at fault), but also wants to same the insurance company as much as they can. So things don't really add up. I haven't received an estimate yet from the adjuster as they said its a complicated situation with many moving parts and that something should be worked out by tomorrow. Well after all of that and my uneasiness about the situation, I contacted a lawyer. This is why... Insurance Litigation. "Bad Faith". First off the adjuster works for my insurance company and is in a biased position to make the favors work more for the insurance company and not, the victim. And depending on what the price of the estimate that comes back, it could be bad faith due to a lower monetary return than what it should be. Anyway I guess I get to sit on this one for another day. I'm just hoping i can have a new bike before this three day weekend I have with the weather supposedly going to be great.

did you have the aftermarket parts on your insurance?...when i totaled my hypermotard i had a extra 15k in extras plus riding gear...and i came out smelling like roses....got 24.5 and my bike back just paying an extra 14 bux a month...it can get alittle messy with aftermarket parts when you dont have the extra coverage....anyhow hope everything works out for you!..im sure it will...

I think you misunderstood iGoldeneye's post, but I will stay out of that one. :dunno

In reference to the smashing of window tint, I have never known an insurance company to pay to replace window tint. You make it almost seem as if "young punks" are "scared" to smash window tint..If someone is going to smash a window in a car, they are in it for more than just smashing the window. Therefore, the insurance claim is the last thing on their minds.

It is a well known fact that insurance companies are not your friends. Their goal as a business is to be profitable. The only way to be profitable is to get the situation fixed as cheap as possible. :fact

I dont think you are going to like the quote you get from the adjuster, but hey that's just my opinion. Glad to hear the rider is ok, and I wish you the best with your situation.

Yeah I didn't have a good analogy there. I guess what I'm trying to get at is that if someone damaged your property, shouldn't you get back your property exactly how it was before it got damaged? I guess my next post will be what the adjuster comes back with. Sorry for the confusion and ridiculousness in that last post lol.

Whats with this aftermarket extras...some policies cover them without a markup, some dont :fact

Also, As to getting nothing for the accessories, your policy doesn't come into play AT ALL, hers does and everything is covered. Add to it that certain policies (like mine) the aftermarket parts are replacement cost, doesn't matter the age.


Now to make my point more clear....I've been hit in my truck a few times:
1) It was a "company" truck. My company, owned by me
2) Each time ALL decals were replaced not just the damaged ones as the sun fades decals and wouldn't match
3) The "$30/day" that is standard for a rental car was increased to what a full size truck runs as well as I was reimbursed for delivery fees while the truck was in the shop because rental trucks here can not be used to pull a trailer.


The last 2 items would not have occured under my policy, but because it was someone else at fault, they were absolutely covered.

I think that's exactly what I'm getting at. The other person should cover it all! I have an estimated $22000 in damages. The at-fault party has coverage up to $25000 in damages ($25000 is a made up number). My bike should be restored to what is was prior to the wreck with no problem. This is where the insurance company tries to save themselves money. A brand new motorcycle doesn't cost $22k so they aren't spending that much. But they will spend the $15k to save them $7k. Ok I can take that but then I'm left with a stock bike. Now the insurance company has to figure out what all of my aftermarket prices cost. Since majority of them were brand new and hadn't been used except the day of the wreck I should get full retail for them. Since the rest of the aftermarket parts are only within a couple weeks old, the adjuster has to figure out what they are worth. The total amount I spent on aftermarket parts is $6k. The insurance company is looking at a difference of $1k between buying a new bike and replacing the aftermarket parts or just repairing the wrecked bike. By the way they won't repair the wreck bike because it has frame damage. Just saying. Also $15 for a new motorcycle isn't what it would be priced at. I know they use KBB value and that makes my motorcycle come out to around $13k. All in all the adjuster has a lot of math work to do. And if I'm being low balled then i will speak up. For a lot of insurance claims, most people can get almost double of what the adjuster first comes back with. You DON'T have to take the first offer if it seems too low. Well hopefully I can get a number back today. And thank you everyone for your feedback. Also I am not here to offend anyone.

Well I just got my quote back from the insurance company. $19.8k. I said I would take $20k but $200 off isn't bad. They priced the bike at $12.8k and aftermarket plus labor at $7k. I am happy with the turnout. Oh yeah the salvage on my R1 is $3k. So I'm going to buy it back and rebuild it for the track. This leaves me with $16.8 to pay off my $10k loan and put $6.8k down on a new S1000RR.

All true and valid points. I classify myself as an experienced rider. Not a professional by any means. Therefore my R1 will be rebuilt for the track and another motorcycle will care for me on the street. Is another R1 out of the question? Not right now. With many options out there and many opinions there is a lot to take into consideration. Happy safe riding eveveryone.

Hey has everyone forgotten that the BMW has heated grips?! That's why anyone should buy one in my opinion. LOL just trying to ease tensions here. There is always going to be competition between what makes a bike better. I've ridden Suzuki most of my life. I liked the R1 better. If I went to the Suzuki forum I'd be having the same argument. The RSV4 is an awesome bike and I looked into it also. It was a price match for me. I could buy a 2013 R1 for $13.5 OTD and put all of my aftermarket parts on it from my wrecked bike. I look at it this way though, I still own an R1 (it just needs work done to it) so why not own something different.

OP search this forum for reviews on the beamer.. A few months back there was a thread that was named something like " R1 vs. S1000RR "

Alot of guys were saying the build quality on the beamer was hit or miss.. It was pretty good reading if you are considering getting one. If I can find the link I will come back and edit my post for ya! :fact

Thanks for the link to the forum. I went with the S1000RR anyway because I know I have the R1 to bring my spirits up if anything should bring the Beemer down. From first thought of my first ride which isn't much because I'm within the breakin period that has me maxed out at 9k rpm and 12mph. The ride and throttle response is super smoothe. The quick shifter is nice for stock but aftermarket will be in the near future. The exhaust sounds decent for what it is but a full Akropovic is on order. Compared to the R1... Not much to compare so far except it does have more getty up. I felt bad because on my way home another S1000RR pulled up toe on the interstate. I thought it would be rare to see one. Anyway he wanted to pull off on me and I said NO! Until my limiter kicked in and I rode home with my head tucked for the remainder of the time. I don't know why some people say it looks hideous. Guess they are allowed to be opinionated though. If I were to tell anyone here R1 or S1000RR.... I couldn't give them an answer because its too close or they both have pros and cons. Give me another two weeks until I get my exhaust and other mods on and I'll give them an honest answer. Thanks again for the heads up.
