Ok my partner with a 06 ZX10 is in some deep shit!!! This has a long history but shit hit the fan SAT the 28th.My boy let his insurance laps back in Dec 06. So the DMV notified him to turn in his plate,but he didn't,and has been riding(wit no insurance).So fast forward to two weeks ago.He takes the bike to a shop for a full exhaust/commander.We knw the owner of the shop we use to ride wit him.He just opend the shop 2 months ago.But keep in mind he has totaled 4 bikes since we used to all ride.So this sat was nice, he calls the owner of the 10 and ask to take it out,so my boy says why not.My boy tells him becareful the bike doesn't have insurance on it.YOU KNW WHAT HAPPEND NEXT.:lol The bike looks like it was put in a crusher.Well the owner of the shop has no shop insurance/and cant barrow against the shop its to new.Mean time my boy still owes $9600 on the bike.The trooper took the tag on the spot.:lolSo what should he do????Its only a matter of time before the bank finds out the bike is totaled.

Learn to work on his own bike in the future!!

In all seriousness, it sounds like the owner of the shop should man up and take responsibility, even if that means making the payments for your "partner"

Thats the thing.Will the bank let you still make payments on a totaled bike?:dunnoCause if you stop paying they have nothing to repo!!! Thats why they require you carry full insurance to protect their bike.

of course they will take your payments :) what is the other alternative? they will take payments even if you do put it in a real crush and make it one square foot all the way around. As long as they get payments they won't care what is done with or to the bike. The problem comes when the payments stop and there is no bike to repo

Bottom line is the bank wants payed, stop makin the payments and all that other stuff is gonna come to light in court and it will be bad for the both of them sounds to me like the shop owner buddy is tryin to bail with all of the excuses he's givin for not fixin the situation

The original plan was for the shop owner to pay him for the bike,so he could pay out the loan from the bank.But when the shop owner was turned down for the loan to cover the bike/has no insurance,their stuck.

Sounds like both people are ****n morons.

In the end, the shop owner (your "friend") needs to own up to it. Personally I'd be all over him, threating a lawsuit and all teh fun stuff a new owner really doesn't want.

Then again I wouldn't ride a bike uninsured and illegal...let alone someone else ride it...:sing:

a) he was stupid for not having any insurance
b) he was stupider for letting someone ride his bike (esp. with a previous crash "record")

I would take the shop owner to small claims court is he doesn't pay for anything

Hahhahah, getting an exhaust/power commander and can not pay insurance. What a joke, be thankful the guy did not total it into a brand new S-class (as your boy would owe for damage on that).

Keep paying the payments and worse case take the owner to small claims court. Did the guy get any tix from the trooper?

Lesson learned for your boy, let no one ride your bike, especially if he has smashed up a few before.

How'd he go down?

The story is full of :bsHe says it was a hit and run at 20mph.The car took off at an intersection,Soon as I saw the pics I :lol 20mph my azz. Guys it cracked the block.the whole nose is tore off/the sub frame broke in 2, both wheels broke in 2 pieces,the tank is crushed flat,And no wittnessis(sp)

Wait...that's a good point and I missed it. he lets his insurance lapse....which will make his bike illegal to ride and can be confinscated...but chooses to go drop at least 1000 dollars, and tha'ts being conservative on a FULL EXHAUST and PCIII?

I'm sorry, but I'm acutally glad he lost his bike. he's a damn moron.

About 5 of our riding partners saw the pics,and all say looks like a looped wheelie.For the tank to be flat like a pancake.Then to disapate the enegry the bike starts to flip end over end.Shattering wheels/sub frame and all.

In California the owner of the bike is responsible for insurance. So the owner is responsible for any insurance claim if there is an accident.

I only know this because I checked with my insurance when someone wanted me to ride his bike for awhile so he didn't have to put it in storage mode. Once I found out what the insurances deal was I told him no thanks, as he let insurance laps on it since 1) he wasn't riding anymore and 2) he was selling it.

Oh BTW if he stopped paying, the bank will most definitely chase him down. He'll wont get a cheap loan for a long time, if he thought 20% was high, he'd be wishing he had that.

Oh and since he gave the shop owner permission to ride the bike, the owner is at fault, not the shop.

he's going to get your friend screwed if they try this. the cop took the damn plate, for crying out loud. they all know it's wrecked. bejeebus, there are some dumbasses out there.

i can't see how the shop owner could sue your friend for suffering. if you borrow a car and wreck it, you can't sue the car owner.

in any case, i'm pretty sure that $9600 is out of small claims court range.

your friend should seel the PCIII (if it's not in pieces) and get a lawyer.

This was a small snow ball the got pushed off the top of the MT.Now its outta control.Ya insurance lapsed so what, pay the $50 fee and be done wit it.ya got insurance again.But NOOOO you dont pay and they send for the tag.Which = more fees/ finds.So the weather turns warm and you want to ride, so you still refuse to turn in ya tag. cause its a 30 day wait with proof of ins to get it back.Then ya let a tard ride ya scooter and junk it.He's my man fiddy grand but how dumb do ya have to be.Get this he told my I was dumb for taking my signal lights off.:lol

The shop owner gets $0 for self inflicted pain and suffering from the bike owner. He would only get money from the person that hit him, but that did NOT happen.

His shop would HAVE to have insurance to be in business, it sounds like he is NOT legit! He took out a customer's bike that was at his shop and crashed it. Who's responsible for that?

Take him to court ASAP and at the same time, clear up the DMV / Police issues and KEEP making payments!

And please tell both of these two Springer rejects not to breed!

I remember back when I was a young squid (sailor type) I bought a brand spankin' new '88 FZ750. I had a loan through the Navy Credit Union for it. When they found out I let my insurance lapse, they were going to insure it at some ridiculous rate and charge it to my loan balance unless I reinsured it. Needless to say I reinsured it.

Anyway, my point here is even though he wrecked the bike, the lien holder may require him to insure it anyway once they find out it is uninsured (and they WILL find out.) So, on top of payments, he is now insuring so much tin foil.

Your friend got a rude ass reality check didn't he?

COLLECTION AGENCY and then maybe wage garnishment, or write off the $$ and screw his credit?

The bank will still get their money, or bye bye credit for a few years.

The Insurance Company, or the State was also lazy for not reporting the lapse to the Bank.

I meant to keep paying while suing the shop.
