I really hope she gets the 5 yr max for that one. The only thing that would make this better would be if she had been putting on eye liner and the brush had gone through her eye on impact. Then for the rest of her life she could explain to people why she only has one eye.

great, hope they get more convictions based on this trial!! :chair:

Well whatever she gets won't be enough BUT at least she was found guilty.

now if they could just get all those idiots on phones or reading the paper or got a laptop propped up in their steering wheel while driving that cause accidents convicted for not being attentive while driving a vehicle.

Yeah, way to stick it to all the inattentive drivers out there. Noone will ever risk driving distracted ever again. A person died because of this accident, so we better try to even things out by messing with the other person's life too.

Every time someone posts a story similiar to this one, everyone jumps on the post about how justice is served and hoping the accused rots in prison forever. If that is how you all feel, then fine, so be it. I just hope you realize everytime there is an accident caused by a sport bike rider, there is another group of people out there all saying the same thing about sport bike riders. About how dangerous sportbikes are, how reckless the riders are, and of how they should be banned or restricted on the road.

What happened to the motorcyclist is terrible. Though we all know death is inevitable, it is hard to say anyone is ever ready for it. That applies to both the deceased and their loved ones. I hope the rider did not suffer. I must say, we all know this could happen to either one of us and yet we still choose to ride. As tragic as this sort of thing can be, I do not think we should be vicitimizing the ones involved.

Was the gal wearing a helmet?

Either the crash was high speed or she had no melon bucket on. IMO if the rider had no helmet on she contributed to her own demise. The gal with the nail polish is still liable, but I'm still on the fence as far as intent. The gal driving is brainless and should never be allowed to drive again, but then again should she really be put in jail? I think not.

I dont think it matters really if the biker was wearing a helmet. granted they are their for your protection. but in most states they are optional. people see cagers drive around with no seatbelt ALL the time...but if they get in a wreck and are seriously injured the news story thread isnt followed up with "oh were they wearing a seatbelt" she woulda lived if she had a seatbelt on... etc etc etc.
If i had a cruiser..I wouldnt wear a helmet. sportsbike..yes I wear one.,..because theres nothing to block the wind from killing my eyes. cruisers ive had, had large windscreens on them to block all wind.
just because someone gets on their bike without a helmet doesnt put them in the same catagory as some dipshit behind the wheel of a 2500-5000 lbs vehicle that wants to paint their nails, dial their phone, read the paper, check mascara in the mirror, pop a zit in the mirror, beat the kids that are sitting in the back seat screaming.
I guess i just miss the days when if people had to make a call...they did it at a payphone or in the privacy of their own homes. backseats were close enough to the front seats to where you didnt have to crawl back there to hit the kids...you could reach them without even turning your head haha

People don't realize that everytime they drive, they're in control of a 3500-4000 lb machine. Probation or the 5 year max is nothing, wish she got her fingers cut off. Stupid B*tch

this is one case that could open up allot of other cases....like cell phones ....eating and driving, changing the radio station, kids crying in the back seat and the mother turns around to put the pacifier back in his or her mouth. putting in an address in your GPS...lighting a cigarette ..dropping the cigarette on your lap...spilling your coffee wile driving...or any other liquid drinks..putting your cell phone on charge while driving...
HE WHO HAS NO SIN CAST THE FIRST STONE.......i am guilty of at least 2 of the following list....i guess i have just bin lucky so far....but if i killed a pedestrian or a biker...do i deserve 5 to 10 .....you could one day find your self guilty and serving 5 to 10 just for spilling your coffee while driving:fact

Yeah, and if you don't want to wreck your bike, just never crash. Surely that was not a serious comment...

The way I see it, using the same principal as the prosecutor in this case, you could charge anyone that crashes with the same offense. Are any of us experts when it comes to operating a motor vehicle? Obviously not. So if we operate a motor vehicle we are taking responsibility for the fact that we can not expertly do so. Which means we knowingly operate a motor vehicle that we know we can not handle is every possible situation we may need to, which is reckless. After all, if everyone could handle driving while applying finger nail polish, would we have a problem with them doing so?

Personally I think they should give that bitch 20 years AND never be allowed to operate a motor vehicle again. Some people should not be allowed to drive period. Some out there get in that big metal box and it's like they're neck locks up and they just go. No looking, no checking, just going.

Sad news :/

But prosecutor Mike Mermel said there's a big difference between polishing nails and other forms of distracted driving. "It is not the same as biting a sandwich ... it's a voluntary disablement," he said. "She might as well have been in the back seat making a sandwich."
No, idiot. Eating while driving or talking/texting on the cell phone while driving are just as voluntary when it comes to distractions. Just because more people do those things does not mean they are any more valid. It's not as if someone cannot resist the urge to eat their food in the car. What shit.
